CONFIRMED, KEPT AS IS WITH CAVEATS NOTED 8/5/2026 (owner ruling). Amount verified in the current Municode supplement (product 14562, job 496057, Supp. No. 14 Update 1, codified through Ord. 26-07 adopted 5/4/2026). FMB LDC Part III ch. 2, Art. IV, sec. 2-306(b): Residential, 2,000-2,999 sq ft of living space, per dwelling unit = Parks and Recreation $751 + Multimodal Transportation $909 + Fee Administration $61 = $1,721. The schedule is keyed to LIVING AREA, not housing type. Brackets: <=999 sf $945; 1,000-1,999 $1,430; 2,000-2,999 $1,721; 3,000-3,999 $1,925; 4,000+ $2,078. Sec. 2-302 applies it to the entire incorporated area; sec. 2-303(c) confirms Lee County school and FMB Fire District impact fees are separate and additional. CAVEAT 1 - SB 180, THE HIGHEST VOID RISK IN THE TAIL. Ord. 25-24 NEWLY ADOPTED this article on 11/17/2025, squarely inside the ch. 2025-190 Laws of Fla. window (8/1/2024-10/1/2027) that rendered Walton County's mobility fee void ab initio on its own county attorney's advice. Unlike Walton, FMB has published no repeal, refund or SB 180 analysis. Two independent verifiers found no challenge, repeal or suspension; the 2026 session ended without amending the provision; the Town's ordinance index shows no 2026 impact-fee ordinance (26-01 compensation, 26-06 purchasing, 26-07 smoking, 26-08 charter). No affirmative evidence the amount is wrong, so it stands - but re-check before relying on it. CAVEAT 2 - 'Proposed Total' heading, RESOLVED. The schedule's total column is literally headed 'Proposed Total'. One verifier flagged this; a second resolved it as a carry-over label from the underlying study rather than a proposed-vs-adopted defect, because the schedule is codified by Ord. 25-24 Sec. 2 (Exh. A), sec. 2-302 applies it townwide, sec. 2-307 makes payment a condition of building permit issuance, and the Town's FY2025-26 adopted fee schedule implements its sec. 2-311 refund provision. Treated as cleared. CAVEAT 3 - POSSIBLE SECOND ADMIN CHARGE, UNRESOLVED. Sec. 2-310(e) authorizes a 3% administrative charge 'in addition to the impact fee amounts required by this article', yet the schedule already contains a Fee Administration line inside the total. They do not reconcile: $61 on a $1,660 base is 3.7%, not 3%. Either the 3% IS that line under different rounding, or a permittee is billed roughly $51.63 more. Note this row is already consistent with the owner's 8/5/2026 Aventura-format ruling, since its administrative charge is inside the codified total.

Fort Myers Beach: Multifamily Impact Fees

A new multifamily unit in Fort Myers Beach pays $11,975.75 per unit in impact fees (rates sourced August 5, 2026). Of that, Lee County-levied fees account for $10,545.75 and municipal or utility fees for $1,430.00.

The largest line items are Roads Impact Fee - Mid-Rise (3-10 stories, 52.5%) ($3,024.00), Wastewater Connection Fee (MF - LCUB) ($2,660.00) and Water Connection Fee (MF - LCUB) ($2,444.00).

CONFIRMED, KEPT AS IS WITH CAVEATS NOTED 8/5/2026 (owner ruling). Amount retrieved via the Municode content API (product 14562, last updated 8/3/2026). FMB LDC ch. 2, Art. IV, sec. 2-306 'FORT MYERS BEACH IMPACT FEE SCHEDULE', Residential Development, '1,000 to 1,999 sq ft of living space dwelling unit' = Parks and Recreation $624 + Multimodal Transportation $755 + Fee Administration $51 = $1,430. THE SCHEDULE IS KEYED TO LIVING AREA PER DWELLING UNIT, NOT HOUSING TYPE, so it applies to a multifamily unit directly - this is not a per-connection charge republished per unit. The project's canonical 1,000 sq ft MF unit falls in this bracket. Sec. 2-307 makes payment a condition of building permit issuance. Corroborated as operative by the Town's FY2025-2026 adopted fee schedule, whose refund policy expressly implements 'Refund of Impact Fees per ... Sec. 2-311'. CAVEAT 1 - SB 180, THE HIGHEST VOID RISK IN THE TAIL. Ord. 25-24 NEWLY ADOPTED this article on 11/17/2025, inside the ch. 2025-190 Laws of Fla. window (8/1/2024-10/1/2027) that voided Walton County's mobility fee. No SB 180 challenge, repeal or suspension by the Town could be found by either of two independent verifiers, the 2026 session ended without amending the provision, and the article remains codified and in force - so there is no affirmative evidence the amount is wrong. Re-check before relying on it. CAVEAT 2 - 'Proposed Total' heading, RESOLVED. The total column is headed 'Proposed Total', which is a carry-over label from the underlying study rather than a proposed-vs-adopted defect: the schedule is codified by Ord. 25-24 Sec. 2 (Exh. A), sec. 2-302 applies it to the entire incorporated town, and sec. 2-307 conditions permit issuance on payment. CAVEAT 3 - POSSIBLE SECOND ADMIN CHARGE, UNRESOLVED. Sec. 2-310(e) authorizes a 3% administrative charge 'in addition to the impact fee amounts required by this article', yet the schedule already carries a Fee Administration line inside the total. They do not reconcile: $51 on a $1,379 base is 3.7%, not 3%. Either the 3% is that line under different rounding, or a permittee pays roughly $42.90 more. This row is already consistent with the owner's 8/5/2026 Aventura-format ruling, since the administrative charge is inside the codified total. How impact fees work in Florida

Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.

Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.

Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
