- Water Availability Fee (City of Stuart)$1,933.00City of Stuart UtilitiesCONFIRMED 7/12/2026 — CORRECTED off a $0 placeholder. Stuart DOES levy a water availability fee (expressly called an impact fee): Code Sec. 42-94, Appendix A Fee/Rate/Charge Schedule, code current through June 18, 2026. Sec. 42-94(c): $1,933.00 per equivalent residential connection for service INSIDE the city ($2,416.00 outside city). SFR = 1.0 ERC. Payable before building permit issuance. The prior record wrongly concluded 'no capacity fee found' from Sec. 42-3 tapping charges alone; tapping charges (Sec. 42-3(6)) are a separate physical-connection charge.

Sec. 42-94(e) sets ERC by design flow: residences, single- OR multiple-family, per dwelling unit — 1BR/<=750 sf = 100 gpd; 2BR/751-1,200 sf = 200 gpd; 3BR/1,201-2,250 sf = 300 gpd; 4BR/2,251-3,300 sf = 400 gpd. The 1-ERC minimum is entered as the default. NOT METER-BASED: Sec. 42-94(e) sets the nonres ERC factor from a published gallons-per-day table by land use and occupancy (e.g. doctor/dentist office 250 gpd per practitioner + 15 gpd per employee; factories 15 gpd per employee, 25 with showers; barber/beauty 75 gpd per chair) — so the ERC count is use-specific, not a meter ladder. STILL UNCONFIRMED: the gpd-per-ERC divisor that converts that flow table into an ERC count is not published in Appendix A or Ch. 42; the meter-based ERC factors in Sec. 42-3(4)d (5/8" = 1.0, 1" = 2.5, 1.5" = 5.8, 2" = 8.0, 3" = 15.0, 4" = 25.0, 6" = 50.0, 8" = 80.0, 10" = 115.0) govern MONTHLY base fees, and it is unproven that they also govern the availability fee. - Sewer Capacity Fee (City of Stuart)$0.00City of Stuart Utilities$0 CONFIRMED ON AUDIT 2026-07-14 — the City of Stuart levies NO sewer capacity/availability/impact fee. Proved from the City's COMPLETE adopted fee schedule: Code Appendix A, Fee, Rate and Charge Schedule (Res. No. 86-2025, Municode current through 6/18/2026). Appendix A's Chapter 42 (Utilities) block carries exactly three entries — Sec. 42-3 (utility deposits, monthly base/volume charges for water AND sewer, and the water system TAPPING charge), Sec. 42-94 (water availability fee, $1,933/ERC — see the Stuart water record), and Sec. 42-169 (stormwater user fee, $7.00/ERU/month, a recurring assessment, not a development fee). There is NO sewer counterpart to Sec. 42-94 anywhere in the Code or the adopted schedule: the asymmetry is deliberate, not an omission — the City codifies its water availability fee but charges nothing one-time for sewer capacity. Stuart's sewer charges are all recurring (monthly base fee by meter-size ERC factor + volume charge). Upgrades the prior '$0 pending confirmation'. Recheck if the City adopts a wastewater capacity fee.
- City Impact Fee (City of Stuart, Commercial)$2.87/sq ftCity of StuartStuart Code Ch. 32, Art. III, Sec. 32-61 (Ord. No. 2508-2022, 12-12-2022), Municode current through June 18, 2026. Schedule row: 'Commercial', Non-Residential block, per 1,000 square feet of FLOOR AREA (GFA). '2026 and Beyond Rate' = the rate now in force: Multimodal $2,109 + Public Safety $764 = $2,873 per 1,000 sf. Parks column is blank for all nonres rows (residential-only). Rate ladder: 2023 $2,314; 2024 $2,500; 2025 $2,686; 2026 and beyond $2,873 — terminal, no further scheduled step-ups. Sec. 32-61(f): up to 3% administrative fee may be added on top. Sec. 32-61(c): fees assessed on the NET INCREASE in impact over the most recent previous use (change-of-use credit). Applies to all new construction within the city limits (Sec. 32-59).
- County Impact Fee (Martin County - Stuart, Commercial)Requires confirmationMartin County Board of County Commissioners$0 — county fee displaced by Stuart's own impact-fee ordinance. LDR §6.3 applies Art. 6 to the unincorporated area AND to incorporated areas 'to the extent permitted by art. VIII, §1(f), Fla. Const.' Martin is a NON-CHARTER county, so under §1(f) a county ordinance is not effective inside a municipality TO THE EXTENT OF CONFLICT with a municipal ordinance. Stuart Code Ch. 32, Art. III (§32-59) levies its own impact fees on 'all new construction within the city limits' (Parks, Multimodal, Public Safety) — a conflicting municipal ordinance. UNCONFIRMED: §1(f) displaces only to the EXTENT of conflict, so the county's non-overlapping components (Public Buildings, Correctional/Law Enforcement, Conservation/Open Space, Library) may still be collectible inside Stuart. NOTE: the residential pass recorded $0 on the (incorrect) basis that Art. 6 governs unincorporated area only — §6.3 does not say that. Verify with Martin County Growth Management (772) 288-5495 and City of Stuart Development Dept.

How impact fees work in Florida
Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.
Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.
Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
