The town's Code Book index page links Chapter 102 (Fees) under a scanned filename rather than the CA1432 pattern used by the other chapters, so it drops out of a naive chapter listing. Chapter 102 Article IV is titled 'New Development Impact Fees', adopted 6-6-2005 by Ord. No. 5-O-2005 and amended 1-3-2017 by Ord. No. 2016-O07 and 8-17-2020 by Ord. No. 2020-O07. Sec. 102-22 as currently supplemented (Supp 15, Nov 2020): 'New residential development shall be assessed an impact fee of $3,000 for water and wastewater infrastructure, $200 for streets, and $500 for parks and recreational infrastructure per unit for development within the Town's limits' = $3,700 per unit. Outside the town limits the residential impact fee is $3,750 for water and wastewater plus a $750 surcharge = $4,500 per unit. Sec. 102-28 defines 'unit' as one dwelling. Sec. 102-24 requires payment before issuance of any new building permit; Sec. 102-25 refunds all but 5% if the permit expires unused; Sec. 102-26 lets the Council reduce or waive the fee where a developer conveys an offsetting benefit. Corroboration that the article is live: the town's Disposition List records Ord. 5-O-2005 'New development impact' at Ch. 102 Art. IV and Ord. 2016-O07 'Fees: new development impact fees amendment' at Ch. 102 Art. IV, with no repeal; the only suspension on record is Ord. 2011-O03, a six-month suspension in 2011 that lapsed. TRAP: the town's Building & Zoning Permits page links a stale copy of Chapter 102 (Chapter_102_-_Fees.pdf, generated January 2018) that still shows the superseded 2017 amounts of $1,500 water and sewer plus $250 parks = $1,750; the Code Book copy cited here carries the current 2020 amendment, and the companion Ord. 2020-O07 amendments to Ch. 190 connection charges confirm the 2020 supplement is the operative one. This impact fee is separate from and on top of the Ch. 190 water and wastewater connection charges of $1,300 each. SB 180 check: the operative amendment is dated 8/17/2020, nearly four years before the 8/1/2024 retroactive date, and no post-8/1/2024 Callahan impact fee adoption or increase was found, so the SB 180 restriction on adopting or increasing impact fees does not reach this fee. How impact fees work in Florida

Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.

Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.

Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
