Internal research note: two independent affirmative sources. (1) Town of Hilliard Code of Ordinances on Municode (product 14456, job 477242, updated 7/17/2026): Part II has no impact fee chapter, and Part III Land Development Regulations ch. 62 has sixteen articles (in general, administration and enforcement, district regulations, PUDs, supplementary regulations, signs, flood damage prevention, airport zoning, proportionate fair-share, landscaping, trees, subdivisions, platting, design standards, required improvements) — no impact fee article. (2) The town's Amended Unified Fee Schedule, Resolution 2026-06 adopted 6/18/2026, is a 22-page consolidated schedule of every town fee; its table of contents covers water and sewer charges, culvert charges, zoning and land development regulation fees, building permit fees and parks and recreation fees, with no impact fee category anywhere. The town's only charges on new development are utility system development charges (water $330.00, sewer $1,885.00 per equivalent single-family unit, code ch. 58 art. IV) and water/sewer tap-in fees ($1,700 short water tap, $2,500 long water tap, $3,500 single sewer tap). SB 180 check: the town's only post-8/1/2024 fee increase is Ord. 2025-08 (water and sewer usage rates, adopted 11/20/2025, effective 1/1/2026), which is a utility rate, not an impact fee or land development regulation, so SB 180 is not implicated on this row. 8/5/2026.

AMOUNT CURRENT, PER-TAP BASIS — MF APPLICATION UNRESOLVED (re-checked 8/3/2026). Hilliard Unified Fee Schedule, Resolution 2026-04 (adopted Jan 2026): Water Tap-In $1,700 'Single Short' (existing main on same side of road; includes saddle, corp stop, 1" poly service, meter, box, restoration); $2,500 'Single Long.' No multifamily/per-dwelling-unit provision anywhere in the resolution — and a separate 'Subdivision Water Tap-ins' line (developer-installed infrastructure, meter-set only) suggests a LOWER charge may apply in developer-built MF projects. AMOUNT VERIFIED 2026-07-31: $3,500 single-service sewer tap-in printed in Res. 2026-04 Unified Fee Schedule p.4 (townofhilliard.com PDF); double-service tier prints $3,800 (sibling row currently $0 — see mismatch report). • Municipal Impact Fee (Town of Hilliard, MF) — none identified
    Per unit
    Town of Hilliard
Internal research note: same finding as the Hilliard SFR row. The Town of Hilliard's code (Municode, updated 7/17/2026) has no impact fee chapter in Part II and no impact fee article among the sixteen articles of Part III ch. 62 Land Development Regulations. The town's 22-page Amended Unified Fee Schedule, Resolution 2026-06 adopted 6/18/2026, enumerates every town fee — water and sewer charges, culvert charges, zoning and land development regulation fees, building permit fees, parks and recreation fees — with no impact fee category. There is therefore no municipal impact fee on multifamily development. For context, the town's utility system development charges are $330.00 water and $1,885.00 sewer per equivalent single-family residential unit, and the code's ERU table assigns 1.0 ERU to an apartment and 0.95 per unit to duplexes, triplexes and quadruplexes — but that is a utility system development charge, not an impact fee, and is a different fee type from this row. SB 180 check: nothing adopted or increased after 8/1/2024 on this fee type, so SB 180 is not implicated. 8/5/2026.

How impact fees work in Florida

Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.

Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.

Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
