  • Mobility Fee — Transportation (Walton County within DeFuniak Springs)
    Walton County
Walton County adopted a mobility plan (Sept 2023) and a mobility fee by Ordinance 2023-29 on 12/19/2023, amending LDC Ch. 3 (Sec. 3.02.00). The ordinance does not carry the rate table itself: Sec. 3.02.04.C adopts the schedule 'contained within the most recent version of the Technical Report' (Walton County 2045 Mobility Plan and Mobility Fee Technical Report), which is not posted as a text-searchable rate table. Secondary reporting of the adopted schedule (850 Business Magazine) gives a detached single-family rate of $1,362 per 1,000 sq ft in the South Walton assessment area and $356 per 1,000 sq ft in North, and $629 (North Central) / $735 (South Central); Sec. 3.02.15.B adds a Jan 1 inflation adjustment each year beginning 1/1/2025. HOWEVER: at its 9/24/2025 meeting the Board of County Commissioners was advised by county legal counsel that 2025 Senate Bill 180 (Ch. 2025-190, retroactive to 8/1/2024 and running through 10/1/2027) rendered the county's ordinance 'void ab initio,' and the Board voted to refund roughly $1.5 million of mobility fees held in segregated impact-fee accounts. The 2026 fix bill (SB 840) passed the Senate 38-0 but died in House Intergovernmental Affairs, so the SB 180 restriction is still running. I could not obtain a county-published statement of whether the mobility fee is currently being assessed at building permit; waltonclerkfl.gov ordinances 2025-01 through 2025-24 and 2026-01 through 2026-08 contain no re-adoption or repeal of the mobility fee, and civicweb/CivicClerk agenda documents are behind a login. Amount therefore left at 0 and flagged rather than asserting either the published rate or a documented zero. Municipal applicability: Ordinance 2023-29 Sec. 3.02.08.E provides that 'any municipality that opts-in to the County's system shall enter an interlocal agreement with the County,' and Sec. 3.02.09 requires an opt-in municipality to establish its own mobility fee fund accounts per that interlocal agreement - i.e. the county fee reaches a city only by interlocal agreement. The county's 2021 pre-adoption FAQ says DeFuniak Springs, Freeport and Paxton were 'currently included' in the plan and fee and that municipalities 'may opt-out,' which conflicts with the adopted opt-in structure. No executed interlocal agreement and no county-published list of participating municipalities could be located, so per the Florida addendum this is INFERRED_0, not a documented zero. 8/5/2026

How impact fees work in Florida

Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.

Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.

Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
