  • Water Impact/Capacity Fee (City of Leesburg, SFR)
    City of Leesburg
UPDATED 2026-08-05 from $820 to $2,039/ERU, and unflagged. Leesburg Ordinance 25-66 passed second reading 4-0 on 10/13/2025 and took effect 12:01 a.m. 11 January 2026, raising the Sec. 22-324 water impact fee from $820 to $2,039/ERU (and the Sec. 22-325 wastewater fee from $1,940 to $4,567). Adopted via the Florida Impact Fee Act extraordinary-circumstances path after workshops 8/11 and 8/25/2025 on the Raftelis study of 9/4/2025. Two independent retrievals via the CivicClerk OData API: the adopted 10/13/25 minutes recording 'ADOPTED ORDINANCE 25-66' with roll call, and the 10/13/25 agenda packet carrying the strike-through amendments. WHY IT WAS STALE: Municode still shows $820/$1,940 because Leesburg is codified only through Ord. 24-62 (10/14/2024) - a codification lag of over a year. The ordinance also REMOVES automatic indexing (retires Sec. 22-327), so no annual escalation should be assumed. This same increase also affects the Mascotte wholesale pass-through note, which has been updated. Round-3 2026-08-05; docs/verify-r3-mixed.json.

The SFR wastewater figure is unambiguous in the adopted packet. Two independent retrievals (adopted minutes + agenda packet) via the CivicClerk OData API. UPDATED 2026-08-05 from $683 to $1,698.49, and unflagged. Leesburg Ordinance 25-66 (adopted 10/13/2025, effective 11 January 2026) raised the water impact fee to $2,039/ERU. The city's published multifamily factor is 0.833 ERU per unit, so 2,039 x 0.833 = $1,698.49. This is the SAME methodology already in the base - the prior $683 was 820 x 0.833 - applied to the new adopted rate, and the finding records all water figures as unambiguous. • Sewer Impact/Capacity Fee (City of Leesburg, MF)
    City of Leesburg
UPDATED 2026-08-05 to $3,804.31 but KEPT FLAGGED - the one cell in the Leesburg increase with a residual ambiguity. Leesburg Ordinance 25-66 (effective 11 January 2026) raised the wastewater impact fee to $4,567/ERU. Applying the city's published 0.833 multifamily factor - the SAME method the base already used ($1,616 was 1,940 x 0.833) - gives 4,567 x 0.833 = $3,804.31, and the adopted packet's Duplex line at the same 0.833 factor prints $3,804, which corroborates this reading. THE AMBIGUITY: the packet's Multi-Family 1-2 bedroom line prints $3,046, which is inconsistent with its own 0.833 factor (0.833 x 4,567 = 3,804, not 3,046) - the verifier judged this a column-alignment artifact or scrivener's error in the strike-through table. Because two readings exist ($3,804.31 by the city's own factor vs $3,046 as printed on the MF line), this cell stays flagged until confirmed against the codified or executed ordinance. The figure carried ($3,804.31) is the factor-consistent one; do not present it as settled. SFR wastewater ($4,567) and all water figures are unambiguous and were unflagged. How impact fees work in Florida

Florida impact fees are one-time charges on new development, governed by Section 163.31801, Florida Statutes (the Florida Impact Fee Act). The statute requires fees to be based on the most recent and localized data, spent on the infrastructure category they were collected for, and adopted by ordinance.

Since 2021, the law also limits how fast fees can rise: increases up to 25% phase in over two years, increases of 25–50% phase in over four years, and increases above 50% are allowed only with a demonstrated extraordinary-circumstances study and at least a two-thirds vote of the governing body.

Counties and cities can both levy impact fees. Inside an incorporated city, a project typically pays the county's countywide fees plus any municipal fees the city has adopted, which is why totals differ between a city and the unincorporated county around it.
